Abstract
Namjera ovog diplomskog rada je istražiti mogućnosti i uvjete pružanja besplatne pravne pomoći kroz pravne klinike. U prvom dijelu rada ukratko će se definirati koncept pravnih klinika kao poseban oblik nastave te njihov povijesni razvoj koji je okosnica za cijelu tematiku. Pružanje besplatne primarne pravne pomoći građanima Republike Hrvatske uređeno je brojnim propisima, a poseban će naglasak biti na zakonskom okviru pružanja besplatne pravne pomoći te kako je to bilo regulirano do donošenja... More novog Zakona o besplatnoj pravnoj pomoći i kako je regulirano danas. Vrlo je važno razgraničiti primarnu od sekundarne pravne pomoći, a nakon navedenog razgraničenja naglasak će biti na pružanju primarne pravne pomoći kroz pravne klinike. Također će se govoriti o ovlaštenim pružateljima primarne pravne pomoći, njihovim korisnicima te samom načinu financiranja pravne pomoći putem pravnih klinika. U tom kontekstu postoji niz problema i nedostataka, a kao glavni nedostatak ističe se položaj pravnih klinika u sustavu obrazovanja. Razmotrit će se problematika nedostatne uređenosti položaja pravnih klinika unatoč tome što kliničko obrazovanje zasigurno podiže kvalitetu studiranja na pravnim fakultetima u Hrvatskoj i doprinosi njihovoj učinkovitosti, a samim time i većoj kvaliteti pravnog obrazovanja općenito. Pravne klinike pružaju inovativan pristup obrazovanju za buduće pravnike. Metoda poučavanja koja se koristi u pravnim klinikama ima za cilj podizanje svijesti studenata o pravnim pitanjima. Također je važno razmotriti i mogućnost uvođenja kliničkog obrazovanja u kurikulume fakulteta jer se može smatrati odgovorom na niz otvorenih pitanja vezanih za problematiku kliničkog obrazovanja i takav pomak bio bi u skladu s obrazovnim ciljevima pravnih fakulteta kao i krajnjim strateškim ciljevima fakulteta. Obrazovanje bi se na taj način podiglo na višu razinu kako na zadovoljstvo samog fakulteta, tako i primatelja i davatelja pro bono pravne pomoći. Less
Abstract (english)
Purpose of this graduate thesis is to investigate possibilities and requirement of providing free legal aid trought legal clinics. At the first part we will define the concept of legal clinics such af a special form of instruction and historical development which is the backbone of the whole topic. Giving the primary and free legal aid to the citizens of Croatia is regulated by many of regulations and we will also have a special accent on the legal framework of providing free legal aid and... More how it was regulated before of adoption of the new law about free legal aid, but how it is today. It is very important to make difference between primary and secondary legal aid and after mentioned, accent will be on providing primary legal aid through legal clinics. We will also talk about authorized primary care providers, their users and way of financing legal aid through legal clinics. In this context, there are a couple of problems and flaws, and I consider the main flaw of the position of the legal clinics in the educational system. We will consider why is this still so poorly regulated even if clinical education certainly improves the quality of studying at the Law faculties in Croatia and contributes to efficiency and in that way make a better quality of legal education in general. Legal clinics provide an innovative approach to education for future lawyers. The teaching method used in the legal clinics for the goal have a raising students' awareness of legal issues. We will also consider the possibility of introducing clinical education in the curriculum of the faculty because I consider this an answer about issues of clinical education and that a progress would be proper with the educational goals of Law faculties as well as the ultimate strategic goals of the faculty.
