The subject of this paper is the legal view and analysis of the criminal offence of the criminal harrasment and stalking. Criminal offence of stalking included in article 140. of the Criminal code, into our criminal legislation was introduced in year 2013. on the recommendation of the Council of Europe. The paper begins with the examination of the development of the idea of intrusive behavior known as stalking in comparative jurisdictions and reviews its gradual criminalization. It brings detailed analyses and defines all of the individual elements and concepts that define intrusive behavior and that must be met according to the legal norms which implicates intrusive behavior, and describes the modus operandi of the perpetrators of this criminal offence. Furthermore, it describes the psychological profile of the perpetrator of the criminal offence and statistics about its prevalence, profile of the victims, causes and consequences of intrusive behavior. It brings examples from case-law that for the moment there are not many. Special attention is given to the problem of intrusive behavior through the sphere of family violence as it is the most common of all the diversity of forms. The paper is detailed in the ways of investigating this criminal act and analyzes the flaws in the system of the sanctioning of the sentenced person in criminal proceedings.
