Abstract
Ovim radom definirat će se značenje upravnog postupka i nadležnost za vođenje upravnog postupka. Nabrojati će se i objasniti načela upravnog postupka jer je jedan od ključnih zadataka voditelja upravnog postupka poštivanje načela postupka pri rješavanju konkretne upravne stvari. Osvrnuti ćemo se na stranke i zastupanje stranaka u upravnom postupku, pokretanje i vođenje upravnog postupka gdje se postavlja pitanje u čijim je rukama inicijativa za pokretanje i vođenje postupka. Detaljno će se analizirati što podrazumijeva nadzor državne granice. Navesti će se u kojim uvjetima će se odbiti ulazak državljaninu treće zemlje u Republiku Hrvatsku. Definirati će se sve o izdavanju vize. U ovom radu temeljno će se obraditi tema nezakonitog ulaska stranca u Republiku Hrvatsku te svi postupci vezanih za njih : zabrana ulaska i boravka, rješenje o povratku, rješenje o protjerivanju i smještaj u centar za strance.
Abstract (english)
This work will define the meaning of the administrative procedure and jurisdiction of administrative procedure. It will also elaborate and explain the principles of administrative procedure because one of the key tasks of the administrative process manager is to respect the principles of the procedure in resolving specific administrative matters. We will be looked back to the parties and representing the parties in the administrative procedure, initiating and conducting the administrative procedure where the question arieses in whose hands is the initiation for starting and running the procedure. There will be detailed analysis what implies oversight of the state border. It will indicate under what conditions the entry of a third country national will be refused into Republic of Croatia. All about issuing a visa will be defined. In this paper, the topic of illegal entry of foreigners into Republic of Croatia will be discussed and all related procedures, like: ban of entering and staying, return policy, expulsion policy and accommodation in the migration center.
