Abstract
Posljednjih 100 godina svjedoci smo nezamislivih ratnih zločina diljem svijeta, najstrašniji među njima je genocide koji je posebno zanimljiv zbog toga što ga nije lako dokazati, pa se često zbog sličnosti dovodi u usporedbu s blažim oblicima ratnih zločina poput etničkog čišćenja i zločina protiv čovječnosti. Naglasak ovog rada upravo je na posebnostima koji razlikuju genocid od ostalih zločina, a to su zaštićene grupe i kompleksnost dokazivanja postojanja genocidne namjere. Rad je podijeljen u nekoliko cjelina. U uvodnom djelu naglasak je na pravnog regulativi temeljem Konvencije i Kaznenog zakona. Drugi dio naglašava posebnosti genocida u odnosu na druge zločine, poput postojanja genocidne namjere, zaštićenih skupina protiv kojih je umjerena i radnji kojima se izvršava. U tom djelu prolazimo i kroz kompleksnost dokazivanja postojanja genocidne namjere. U završnom djelu rada nalaze se primjeri nekoliko genocida u posljednjih 100 godina u kojima kroz opise strahota koje su se dogodile u Ruandi i Srebrenici i drugdje nastojim pokazati s kakvim se užasima susreću žrtve genocida. Na samom kraju rada naglasak je na Međunarodnom kaznenom sudu kao bitnom instrumentu za sankcioniranje počinitelja takvog strašnog zločina.
Abstract (english)
For the last 100 years, we have witnessed unimaginable war crimes around the world, the most terrible among them being genocide that is particularly interesting because it is not easy to prove. Genocide is often due to its similarity in comparison with the lenient forms of war crimes such as ethnic cleansing and crimes against humanity. This disquisition is divided into several units. In the introductory part, the emphasis is on legal regulations under the Convention and the Criminal Law. The second part of the paper highlights the particularities of genocide in relation to other crimes, such as the existence of genocidal intent, the protected groups against which it is directed and the actions to be carried out. In that part we also go through the complexity of proving the existence of genocidal intent. In the final part of the paper, there are examples of several genocide in the last 100 years, in which, through the description of horrors that occurred in Rwanda and Srebrenica, and elsewhere, I try to show what the victims had to deal with. At the very end of the work I attempt to show that the International Criminal Court is extremely important for sanctioning the perpetrators of such a horrific crime.
