Abstract
Stadiji počinjenja kaznenog djela su: donošenje odluke, pripremne radnje, pokušaj i dovršeno kazneno djelo. Svi ti stadiji su mogući ali nisu svi nužni. Primjerice, počinitelj svakako mora donijeti odluku o počinjenju kaznenog djela, ali ne mora obaviti pripremne radnje niti pokušaj. On može nakon donošenja odluke odmah pristupiti počinjenju kaznenog djela. Pripremne se radnje poduzimaju s ciljem da se olakša počinjenje kaznenog djela i one u pravilu nisu kažnjive. Kod pokušaja djelo mora biti započeto, mora postojati namjera, ali ono ne smije biti dovršeno. Razlikujemo i nekoliko vrsta pokušaja, kao naprimjer neprikladni pokušaj i neuspjeli pokušaj, a može doći i do dobrovoljnog odustanka od počinjenja kaznenog djela. Kod dobrovoljnog odustanka važno je da je počinitelj sam odlučio prekinuti započetu radnju promjenom svoje prvotne odluke. Posljednji stadij je dovršeno kazneno djelo, kada je počinitelj uspio u svome naumu.
Abstract (english)
The stages of committing criminal offence are: making a decision, preparatory acts, an attempt and completed criminal offense. All of the mentioned stages are possible, but not necessary. For example, a perpetrator definitely has to make a decision on committing a criminal offence, but does not have to make any preparatory acts or attempts. The perpetrator can commit a criminal offence right after making a decision. The purpose of making preparatory acts is to alleviate the committing of criminal offence and it is usually not punishable by law. An attempt means that the offence has started, there is an intent, but the criminal offence is not completed. There are several types of attempts, e.g. inappropriate attempt, failed attempt, and also the voluntary withdrawal of committing a criminal offence. It means that the perpetrator himself decided to stop the act he started, by changing his initial decision. The last stage is a completed criminal offence, when the perpetrator has succeeded to complete his plan.
