The topic of this paper is right ot be forgotten. It is defined as a right of individual to request that personal information be removed from the internet. This paper will offer short introduction about legal documents related to privacy protection in Europe, and legal means used to protect that private data as they are foundations upon which right to be forgotten is built. Analysis of judgement of European Court of Justice in so called „Google Spain“ case will provide insight in Court argumenation and their interpretation of certain legal documents, relevant to this judgement. Next there are certain criteria which needs to be defined in order to be able to perform specifc balancing test between individual rights and freedoms of the data subject on one hand and public right to access information on the other. This balancing test is essential for determining right to be forgotten in each individual case. Google transparency report will provide insight in structure of requests Google recived concerning right to be forgoten. That report will show the context in which right to be forgotten was mostly used.
