Abstract
Predmet rada je upoznavanje s institutom susjedskih prava, njihovim obilježjima, koje vrste susjedskih prava postoje u hrvatskom zakonodavstvu, te na koji način se ostvaruje njihova pravna zaštita. Susjedska prava vrsta su posebnih ograničenja prava vlasništva. Regulirana su Zakonom o vlasništvu i drugim stvarnim pravima. Najveći dio rada posvećen je dvjema susjedskim pravima: međi i imisijama. Međa je zamišljena crta ili linija koja razdvaja dvije susjedne nekretnine. Ona se uređuje u izvanparničnom postupku u kojem razlikujemo obnovu i ispravak međe. Imisije su fizičke smetnje koje dolaze s jedne nekretnine i ometaju korištenje druge nekretnine. Razlikujemo dopuštene i nedopuštene imisije.
Abstract (english)
The subject of this paper is getting acquainted with the legal institute of neighbours rights, their features, what kind of neighbours rights exist in Croatian legal legislation and how to execute legal protection of neighbours rights. Neighbours rights are special restrictions on ownership rights. They are regulated by the Law on Ownership and Other Proprietary Rights. The biggest part of this paper refers to two neighbours rights: boundary line and emission. Boundary line is an imaginary line or line that separates two neighboring real estates. It is regulated in an extra-judicial procedure in which we distinguish the renovation and correction of the boundary line. Emissions are physical disruptions that come from one property and hinder the use of another property. We distinguish permissible and non-permissible emission.
