Abstract
Ovim radom se ukazuje na kompleksnost zaštite prava osoba s invaliditetom te koji mehanizmi pravne zaštite im stoje na raspolaganju.Važnost instituta skrbništva nad punoljetnim osobama proizlazi iz činjenice da oko 650 milijuna ljudi na svijetu čine osobe s invaliditetom zbog čega ih je potrebno zaštititi dodatnim normativnim mehanizmima. Suvremene države na zakonodavnom planu posvećuju veliku pozornost u svrhu zaštite prava osoba s invaliditetom na što je u ovom radu ukazano primjerom Njemačke, Austrije i Mađarske.Stoga, ovaj rad, u svojoj suštini, ukazuje na pozitivne i negativne strane instituta skrbništva nad punoljetnim osobama s osvrtom na novo obiteljskopravno uređenje.Rad je koncipiran u šest cjelina. U uvodu je ukratko opisana problematika zaštite prava osoba s invaliditetom s naglaskom na važnost opstojnosti osobnog i obiteljskog života i dostojanstva osobe s invaliditetom. U drugoj cjelini navedeni su statistički pokazatelji registriranih osoba s invaliditetom na razini županije i na državnoj razini u razdoblju od 2006. do 2016. kojima se ukazuje na povećanje broja registriranih osoba s invaliditetom. Treća cjelina daje pregled pravnih izvora zaštite prava osoba s invaliditetom na nacionalnoj i međunarodnoj razini, koja se utvrđuje primjerima iz sudske prakse koji su razrađeni u četvrtom cjelini. S obzirom na velike razlike u zakonodavstvima država, u petoj cjelini ukratko je opisan pravni položaj osoba s invaliditetom u drugim granama prava i usporednim pravnim sistemima Na kraju je dan osvrt na cjelokupan diplomski rad.
Abstract (english)
This paper points out the complexity of protecting the rights of persons with disabilities and the mechanisms of legal protection available to them.The importance of the Adult guardianship institution comes from the fact that around 650 million people in the world live with disabilities which is why it is necessary to protect the normative mechanisms. Modern societies, such as Germany, Austria and Hungary pay great attention in the legal sector to protecting their rights.Therefore, this paper in its essence indicates the positive and negative sides of the Adult guardianship system, with emphasis on the new family law regulation.The work is divided into six units. The introduction briefly describes the problem of protecting the rights of persons with disabilities, with an emphasis on the importance of their personal and family life and their dignity. Second unit shows statistical information about persons with disabilities registered at the country and the national level in the period from 2006 to 2016. Third unit gives an overview of the sources of protecting the rights of persons with disabilities at national and international level, which is established by case law that is further developed in the fourth unit. Due to the big difference in the legislation of the country, the fifth unit briefly describes the legal situation of persons with disabilities in other areas of law and comparative legal systems. In the end is a brief summary of the entire thesis.
