Officials are persons who, in the administrative bodies of local units as a regular occupation, perform tasks from the self-governing powers of local units and the tasks of state administration entrusted to these units, in accordance with the Constitution and with the law. Officials are also persons who carry out general, administrative, financial, material-financial, accounting, information and other professional tasks in the administrative bodies of local units. The totality of the rights, obligations and responsibilities of officials and employees makes their official duty. Violation of official duty is subject to liability for breach of official duty. Employee's rights, obligations and responsibilities are adequately applied to the rights, obligations and responsibilities of officials, and employees for violation of their duty, which is the totality of their rights, obligations and responsibilities from the employment relationship. The purpose of the breach of official duty is to ensure the effective and legitimate performance of official duties and to protect the honor and reputation of the civil servant or the reputation of the service as a whole. In other words, without discipline or without respecting the rules of work and behavior, it is impossible to accomplish tasks or to preserve the reputation of the service. Responsibility for the violation of an official duty can be defined as the liability of a civil servant for violation of legal obligations and rules of profession, for which a prescribed punishment is prescribed in the prescribed procedure by the competent authority.
