Abstract | Diplomski rad bavi se problemom informiranja, poglavito kroz prizmu prikupljanja, obradu, korištenje i zadržavanje informacija od strane operatera koji su nastali i djeluju u suvremenim informatički uvjetima, te u kontekstu toga njegovom odgovornošću. U radu je ukazano na značaj, ulogu i moć informacija u suvremenom globalnom društvu, koje počiva na slobodi kretanja ljudi, roba, rada, tehnologije i kapitala. Isto tako ukazano je i na mogućnost zlouporabe informacija i informiranja, te na štetu koje takve zloupotrebe mogu prouzročiti za oštećenog. Obzirom na to da se rad posebno bavi pravnim problemima vezanim uz informacije i informiranje u novo nastalim društvenim odnosima i suvremenim informatičkim sredstvima i na njima nastalim novim poduzetničkim subjektima (operaterima), koji se radi ostvarivanja dobiti bave takvom djelatnošću. U radu se ukazuje na problem pravne podnormiranosti ovog područja društvenih odnosa i kako ona utječe na ustavom i konvencijama zaštićena ljudska prava i slobode. Osobito onih koja čine bit ljudskog dostojanstva, prava osobnosti i zaštite obitelji. Nadalje, rad obrađuje sudsku praksu Europskog suda na konkretnom primjeru povrede prava trećih zloupotrebom informacije. U radu je obrađeno zakonodavno reagiranje EU parlamenta i Europskog vijeća donošenjem Opće uredbe za zaštitu osobnih podataka, inicirana, upravo, presudom Europskog suda. Prikupljanje, obrada, i zadržavanje informacija je djelatnost značajna za ostvarivanje prava i sloboda. Međutim, svaka njihova zloupotreba je opasna i u pravilu dovodi do povrede jednog, a češće i više ljudskih prava i sloboda. Zbog toga, pravo na pristup informacijama kao ljudsko pravo nije i ne može biti apsolutno. Ono je podvrgnuto ograničenjima, radi zaštite prava drugih, pravnog poretka, javnog morala, nacionalne (i za države članice EU) i europske sigurnosti. Može biti ograničeno u unutarnjem pravnom poretku samo zakonom, a na nivou EU pravnim propisom snage zakona, dakle Uredbom. Svako ograničenje mora biti razmjerno potrebama demokratskog društva s jedne strane, te nužno u odnosu na potrebe zaštite osobnih prava i sloboda, a s druge strane razmjerno legitimnom cilju u javnom interesu. Nepoštivanje prava i obaveza u korištenju informacija kod informiranja povlači na zahtjev podnositelja, čija su prava povrijeđena, pokretanje postupka utvrđivanja odgovornosti pred nadležnim tijelima (sudovima) te utvrdi li se i naknadu štete. Diplomski rad nastoji prikazati kako bi trebalo pristupiti svim ovim pojavama i tokovima informacija u suvremenim informatičkim odnosima. Rad obrađuje regulativu ovih odnosa i kroz nju nastoji odgovoriti kako se pravno mora postupati polazeći od primjene prije svega, normi sadržanih u odgovarajućim člancima Ustava Republike Hrvatske, te u Općoj uredbi o zaštiti osobnih podataka EU-a. |
Abstract (english) | The thesis deals with the problem of information, especially through the prism of collecting, processing, using and retaining information from the operators who were created and operating in modern IT conditions and in the context of its responsibility. The paper highlights the importance, role and power of information in a modern global society based on the free movement of people, goods, labor, technology and capital. Likewise, there is also the possibility of abuse of information and information, and the damage that such misuse can cause to the injured party. Given that the paper deals specifically with legal issues, the connection to information and information in new social relationships and modern IT tools and the new entrepreneurial entities (operators) who are doing so are doing so. The paper points to the problem of legal subordination of this area of social relations and how it affects the constitution and conventions of protected human rights and freedoms. Especially those that make up the essence of human dignity, personality rights and the protection of the family. Furthermore, the paper deals with the case law of the European Court on a concrete example of a violation of the right of third-party abuse of information. The paper deals with the legislative response of the EU Parliament and the European Council through the adoption of the General Regulation on the Protection of Personal Data, initiated by the European Court. Collecting, processing, and retention of information are an activity important for the exercise of rights and freedoms. However, each of their abuses is dangerous and, as a rule, leads to a violation of one and more and more human rights and freedoms. Therefore, the right to access information as human right is not and can’t be absolute. It has been subject to restrictions to protect the rights of others, legal order, public morals, national (and EU Member States) and European security. It can be limited to the domestic legal order only by law, at the level of the EU by the legal rule of law, the Regulation. Every limitation must be proportionate to the needs of a democratic society on the one hand, and necessarily in relation to the needs of the protection of personal rights and freedoms and, on the other hand, to a relatively legitimate aim in the public interest. Failure to disclose the right and obligation to use information when informing is withdrawn at the request of the applicant whose rights have been violated to initiate accountability to the pre-trial bodies (courts), and if it determines compensation for damage. The thesis aims to show how all these phenomena and streams of information should be accessed in contemporary IT relations. The paper deals with the regulation of these relations and attempts to respond to it as it must be legally acted upon, starting with the application of the norms contained in the relevant articles of the Constitution of the Republic of Croatia and the General Regulation on the Protection of Personal Data of the EU. |
