Command responsibility is a special form of individual criminal responsibility and the institute of the international criminal law, from where it was taken over in criminal law of the Republic of Croatia, and it has a two basic forms – direct command responsibility and command responsibility stricto sensu. This thesis focuses on the way in which the institute of command responsibility is regulated in international and croatian criminal law, and some generality about command responsibility. The first part of the paper gives an insight into generality about command responsibility such as: the concept of command responsibility, forms, historical evolution and elements of command responsibility. The second part of the paper elaborates on command responsibility in the international criminal law, respectively the way on which that institute is regulated in Geneva Conventions of 1949 and in the First Additional Protocol of 1977 which supplements Geneva Conventions, and in the Statute of the International Criminal Tribunal for the Formal Yugoslavia of 1993 and the Statute of Rome of 1998 which contains the most complete and precise regulation of indirect command responsibility. The third part of the paper elaborates the way in which the institute of command responsibility is regulated in criminal law of the Republic of Croatia since becoming independent till today while on the Criminal Code of 2011 is in force. This section of the paper gives an insight into the way on which the institute of command responsibility can be applied in legal proceedings that are being conducted, or may be conducted in the near future, against perpetrators of criminal offences that represents international crimes, and which were committed during the Homeland war.
