Abstract
Defenzivna medicina predstavlja praksu do koje dolazi kada liječnici provode pretrage, medicinske postupke, posjete ili izbjegavaju visokorizične pacijente prvenstveno, ali ne i nužno zbog zabrinutosti od odgovornosti za nesavjesno liječenje te se na taj način pokušavaju zaštititi od potencijalnih tužbi i kaznene odgovornosti. U ovom diplomskom radu u središtu razmatranja nalazi se kaznenopravni aspekt defenzivne medicine kao novog problema s kojim se suočava naše zdravstvo. Prvi dio rada daje uvid u općenitosti defenzivne medicine kao što su: pojam defenzivne medicine, uzročnici i posljedice njezinog prakticiranja te kako ona utječe na odnos pacijenta i liječnika. U drugome dijelu ovog rada nalazi se odgovor na glavno pitanje kaznenopravnog aspekta, a to je, možemo li praksu defenzivne medicine podvesti pod biće kaznenog djela nesavjesnog liječenja. Odgovor dobivamo kroz analizu nekoliko bitnih čimbenika- odgovornosti liječnika, odnosu defenzivne medicine s nesavjesnim liječenjem te od velike važnosti, prisutnosti defenzivne medicine u slučajevima iz sudske prakse iz kojih proizlazi kako prisutnost ovog problema predstavlja opasnost za zdravstveno stanje pacijenata, ali i za cijeli zdravstveni sustav.
Abstract (english)
Defensive medicine occurs when doctors order tests, procedures, or visits, or avoid certain high-risk patients or procedures, primarily (but not necessarily solely) because of concern about malpractice liability. This graduate thesis focuses on the criminal law aspect of defensive medicine as a new problem facing our healthcare. The first part of the paper gives as an insight into the generalities of defensive medicine such as: the concept of defensive medicine, the causes and consequences of its practice, and how it affects the patient-doctor relationship. The second part provides as an answer to the main question of the criminal law aspect, which is whether we can bring the practice of defensive medicine under the nature of the criminal offense of medical malpractice. The answer is obtained through the analysis of several important factors- the responsibility of the doctor, the relation of defensive medicine with medical malpractice, and of great importance, the presence of defensive medicine in a cases of law, which shows that the presence of this problem poses as a threat to the health status of patients and the entire health system.
