Abstract
Tema ovog diplomskog rada je tijek ostavinskog postupka kao izvanparničnog postupka koji je u Republici Hrvatskoj reguliran Zakonom o nasljeđivanju. Autor detaljnije obrađuje pojam ostavinskog postupka te njegova načela, nadležnost za raspravljanje ostavine, prethodne radnje koje se sastoje od sastavljanja smrtovnice, popisa ostaviteljeve ostavine, mjera za osiguranje ostavine te proglašenja oporuke. Nakon prethodnih radnji u nastavku slijedi pokretanje ostavinskog postupka te na kraju centralni i ključni stadij ostavinskog postupka-ostavinska rasprava.
Abstract (english)
The subject of this master's thesis is the course of the probate proceeding which is regulated by Inheritance Law in the Republic of Croatia. The author elaborates the term probate proceeding and its principles, jurisdiction for discussing legacy, previous actions which consist of making death certificate, legacy security measure and proclamation of will. After previous actions, initiating the legacy proceeding is the next step and after all, the central and key stage of probate proceeding – inheritance proceeding.
