Abstract Tema ovog diplomskog rada je dijete kao svjedok. Cilj rada je obrazložiti kompleksnost položaja u kojem se dijete nalazi kao svjedok, te navesti važnost za uvijek potrebnim unaprjeđivanjem istog. Naime, svjedoci uživaju određena prava što ću navesti kroz prvi dio rada, ali isto tako za njih postoje određene obveze koje moraju poštivati, čak i pod cijenu kaznene odgovornosti. Radi se obvezi odazivanja na poziv za svjedočenje, izbjegavanje davanja lažnog iskaza, potreba istinitog svjedočenja itd. Kada je u pitanju procesno pravo, posebno mjesto u nacionalnim pravima zauzima institut procesnog pomoćnika što je od velike važnosti jer su većina svjedoka laici. Analogno prethodno navedenom, dolazim do posebno osjetljivih svjedoka koji se dijele u dvije skupine: svjedoci žrtve određenih kaznenih djela, koja su takva da ostavljaju teške posljedice na psihičko stanje žrtve a drugu skupine čine djeca. Nadalje, kroz rad navodim, analiziram i razrađujem čitav niz nastojanja zaštite djeteta kao svjedoka. Zaštita se ogleda, što kroz rad stručnjaka, donošenje nacionalne strategije za prava djece u Republici Hrvatskoj, djelovanje i uloga medija, uloge Centra za socijalnu skrb te uvođenje mehanizama za bolju provedbu i primjenu međunarodnih propisa za zaštitu djece. Posebno se ističe uloga međunarodnih propisa gdje se vidljivo podiže svijest o položaju djeteta, te konkretnije poduzimaju razne mjere kako bi dijete imalo ravnopravan položaj u okviru procesnog prava. Kada je u pitanju hrvatsko pravosuđe, okolnosti i postupci svjedočenja djeteta, ističe se usklađenost s međunarodnim propisima te nastojanje za pronalaskom novih, boljih rješenja. Naravno, to ne isključuje nastajanje određenih problema u praksi. Kako bih što bolje razjasnio položaj djeteta svjedoka u hrvatskom pravosuđu, poslužiti ću se kaznenopravnom zaštitom djece. Razlog tome jest što posljedice takvih postupaka za djecu izuzetno bolne i traumatične. Svakako, posebna važnost i uloga vidi se kod djelovanja centra za socijalnu skrb. Centar za socijalnu skrb ključan je u pripremi djeteta za procesne postupke i vrlo jasno može stvoriti „sliku“ psihofizičkog stanja djeteta. Na kraju rada prikazuje se izvješće o radu pravobraniteljice za djecu iz 2018. godine u Republici Hrvatskoj, gdje se jasno može vidjeti koliko se često djeca susreću s ovakvim situacijama i koliko je to problematično.
Abstract (english) The topic of this paper is a child as a witness. The main aim of the paper is to explain the complexities of the child's position as a witness and to state the importance of its improvement. As I am going to mention in the first part of this paper, witnesses enjoy certain rights but there are still certain obligations they have to respect even under the price of committing an offence. These are the commitment of responding to a call to testify, avoiding giving false statements, necessity of giving true testimony, etc. In terms of procedure law, a special place in the national law is reserved for the institute of the assistant in the procedure, which is of big importance since most of the witnesses are laymen. By analogy with the above mentioned, we come to especially sensitive witnesses. They are divided into two groups, one of which are children. After that I am going to outline, analyse and elaborate a whole series of endeavours in protecting a child as a witness. I am going to do that not only through the historical facts but also through experts’ work, adopting the National strategy for children’s rights in the Republic of Croatia, introduction of mechanisms for better implementation and application of international regulations for protection of children, activities and role the media, and of course role of the Centres for Social Welfare. The role of international regulations is especially emphasized, in which awareness is raised of the child's position and various actions taken so that children would have an equal position within the procedure law. In terms of Croatian judiciary, the circumstances and procedures of a child's testimony, the compatibility with international regulations and efforts for searching new and better solutions are emphasized. Of course, that does not preclude emergence of certain problems in practice. In order to better explain the child's position as a witness in the Croatian judiciary, I will use child protection under criminal law. The reason for that is that the consequences of these kinds of procedures are extremely painful and traumatic for children and regulations from other procedures often indicate regulations from criminal law. Certainly, especial importance and role is observed in the activities of the Centre for Social Welfare. The Centre for Social Welfare is essential when it comes to preparing a child for procedures and it can easily depict an image of the psychophysical state of the child. To substantiate some of the above mentioned statements, in the end of this paper an annual report for 2018 of the Ombudsman for Children in the Republic of Croatia is mentioned, from which one can clearly see how often children are faced with these situations and how problematic is.
