Abstract
Smrtna kazna i njena uporaba oduvijek su izazivale kontroverze te se smatrala jednim od najbitnijih pitanja kaznenog zakonodavstva države i društva. Od davnina su se izvršavale egzekucije iz raznih, moralno upitnih, motiva i ciljeva. Smrtna kazna se provodila kao javna predstava kako bi se ljude zastrašilo i odgovorilo od činjenja kaznenih djela. S vremenom, misao o smrtnoj kazni, njenoj uporabi i načinima izvršenja postajali su sve češće predmetom rasprava. Ima li ta kazna smisla, ima li ona odgojnu svrhu, mora li se koristiti za toliko širok spektar kaznenih djela, nije li život najveće dobro? To su samo neka od pitanja. S 18. stoljećem dolazi i do pojave prvih zagovornika abolicionizma, među kojima je najznačajniji Cesare Beccaria. Od tada, pa do danas, ova kazna se sve manje upotrebljavala i sve više humanizirala. Upravo to nam govori da društvo napreduje te da vodi k tome da se u potpunosti ukine smrtna kazna. Iako dug, ovaj proces bi jednom trebao završiti jer su brojni razlozi za ukinuće smrtne kazne.
Abstract (english)
Death penalty and its practice from the beginning caused controversy and it is considered as one of the most substantial questions of criminal legislation of countries and societas. From ancient times executions were practiced from various, morally questionable, motives and causes. Death penalty were executed as public show to frighten people and to discourage them from doing criminal acts. With time, the idea of death penalty, its practice and the methods of execution became more and more subject of discussions. Does this punishment have some kind of purpose, does it have educational purpose, does it have to be used for variaty of criminal acts, isn't life the greatest good? That were some of many questions. With 18th century, appearance of aboliton supporters arrived, among who Cesare Beccaria is the most important. Since then, to today, this punishemnt has been used less and less and it has been more humanized. Exactly this tells us that society is progressing and that is leading us to abolishing death penalty entirely. Even it is long process, this should have its end someday because there are many reasons for abolishing death penalty.
