This thesis is about the institute of workers responsibility for damages towards his employer. The employment contract is the basis for establishing and the source of law regulating the content of employment, and shall determine the rights, obligations and responsibilities of the subjects in that legal relationship, such as employee and employer. The consequence of non-compliance with the contract of employment is the responsibility for the damage which was created and obligation of repairing the damage done with acts or omission. The Labour Law stipulates preconditions with which there is the responsibility of workers for the damages toward his employer. A worker who at work or in relation to the work deliberately or due to gross negligence causes damage to the employer, is obliged to compensate the damage. The worker is responsible for the damage according to the criteria of proven guilt, which means that the obligation of the employer is to prove the guilt of the worker to a degree of intent or gross negligence. Through the thesis several examples of case law are shown, which are related just to the criteria and the degree of guilt by which the worker is responsible to the employer. Regarding ways of repairing the damage caused, general regulations of law of obligations were used, and it is primarily the Law on Obligations. Following all of the legislations that are closely related to the institute of workers responsibility for damages towards his employer, that institute is broken down in detail, with specific examples from case law.
