Abstract
Cilj ovog diplomskog rada temelji se na prikazu pozitivnopravnih pretpostavki i postupka lišenja poslovne sposobnosti te instituta skrbništva za odrasle kao rezultatima provedene analize. Analiza se sastoji u povijesnom prikazu instituta lišenja poslovne sposobnosti te skrbničke zaštite osoba uzrokovane takvim lišenjem, ali i u međunarodnopravnim tendencijama sadržanima u najvažnijim dokumentima zaštite osobnosti osoba s duševnim smetnjama. Također, u radu se analizira sudska praksa Europskog suda za ljudska prava i Ustavnog suda Republike Hrvatske u kontekstu prava na pravično suđenje te prava na poštivanje osobnog i obiteljskog života kao prikaz problematike hrvatskog pravnog sustava u postupcima lišenja poslovne sposobnosti
Abstract (english)
The main goal of this diploma essay is based on the view of positive law assumptions and procedure for deprivation of legal capacity and custody for the mayors devested of legal capacity. Analysis is based on the historical view of the institute of deprivation of legal capacity and guardianship for the people caused by such deprivation, but also in the international legal tendencies contained in the most important documents to protect of the personality for people with mental disorders. Also, this diploma essay analyses case law by the European Court of Human Rights and Croatian Constitutional Court in the context of the right to a fair trial and the right to respect for private and family life as a representation of the problems of the Croatian legal system in proceedings deprivation of legal capacity.
