Abstract
Tema ovog diplomskog rada su dokazne radnje u kaznenom postupovnom pravu Republike Hrvatske. Kroz ovu temu i diplomski rad objašnjava se sam pojam dokaznih radnji radi jednostavnijeg shvaćanja svrhe njihovog provođenja. Nadalje, navode se vrste dokaznih radnji koje su detaljno razrađene kroz rad. S obzirom na sve veći utjecaj Europske unije i načela uzajamnog priznanja, koje je proklamirano u temelj pravosudne suradnja u kaznenim stvarima u Europskoj uniji, posebna pozornost će se obratiti na pribavljanje i osiguranje dokaza u kaznenom pravu Europske unije. Navesti će se utjecaj nezakonitih dokaza u praksi Europskog suda za ljudska prava koji ne određuje je li neki dokaz u nacionalnom kaznenom postupku bio nezakonit nego je li način njegova pribavljanja ili uporabe protivan Europskoj konvenciji o ljudskih pravima. Na kraju će se rad potkrijepiti primjerima iz sudske prakse.
Abstract (english)
The subject of this thesis (diploma work) is evidence collection in criminal procedural law of the Republic of Croatia. Through this thesis, the concept of evidence collection is explained to make it easier to understand the purpose of their implementation. Furthermore, the types of evidence collection are described in detail in the work. Considering the growing influence of the European Union and the principle of mutual recognition, which has been proclaimed as the cornerstone of judicial co-operation in criminal matters in the European Union, special attention will be given to obtaining and securing evidence in the criminal law of the European Union. There will be specified impact of unlawful evidence in the practice of the European Court of Human Rights which doesn´t determine if any evidence in national criminal proceedings was unlawful but whether the way of obtaining or using is contrary to the European Convention on Human Rights. In the end the work will be supported with examples from court´s practice.
