Abstract
Jedna od najznačajnijih socioloških, gospodarskih i političkih pojava našeg vremena svakako su migracije ljudi, uz koje se veže i problem zaštite ljudskih prava. Pred Europskim sudom za ljudska prava s godinama se pojavljuje sve više slučajeva u kojima je došlo do povrede prava izbjeglica. Iako Europska konvencija za zaštitu ljudskih prava ne predviđa pravo na azil, države članice Vijeća Europe imaju obvezu svakome pod njihovom jurisdikcijom pa tako i izbjeglicama, osigurati poštovanje prava zajamčenih Konvencijom. U ovom radu izložit će se tri glavna prava zajamčena Konvencijom u vezi kojih najčešće dolazi do kršenja iste. To su pravo na život zajamčen člankom 2., zabrana mučenja, nečovječnog ili ponižavajućeg postupanja i kažnjavanja koja je određena u članku 3. i članak 8. kojim se jamči pravo na poštovanje privatnog i obiteljskog života, doma i dopisivanja. U svrhu razjašnjena spornih pitanja razmatrana je i analizirana praksa Europskog suda za ljudska prava.
Abstract (english)
One of the most significant sociological, economic and political phenomena of our time are migration of people that involves the problem of protection of human rights. More and more cases of violations of refugee rights have appeared before the European Court on Human Rights. Although the European Convention on Human Rights does not provide right of asylum, the member states of the Council of Europe are under the obligation to secure to everyone within their jurisdiction, including asylum seekers, the respect of the rights guaranteed by the European Convention on Human Rights This paper will outline three main rights guaranteed under the European Convention on Human Rights which are most often violated. These are the right to life guaranteed under Article 2, prohibition of torture and inhuman or degrading treatment or punishment guaranteed under Article 3, and Article 8 which guarantees right to respect private and family life, home and correspondence. The practice of the European Court of Human Rights is discussed and analysed to show the most important and relevant issues.
