Abstract
Načelo nadređenosti je jedno od temeljnih načela na kojem se temelji cijeli pravni sustav Europske unije. Nadređenost Europskog prava je bitno utjecala na ustavne poretke država članica. Svaka država članica koja želi postati dio europske obitelji mora u svoje zakonodavstvo implementirati pravnu stečevinu Unije. Načelo nadređenosti nas upućuje da u slučaju sukoba između nacionalne norme država članica i norme prava Unije, pravo Unije ima prednost. Dakle, temeljni cilj je osigurati jedinstvenu i efikasnu primjenu europskog prava u svim državama članicama. Razvija se kroz praksu Suda Europske unije. Ciljevi Unije se ne bi mogli ostvariti bez načela nadređenosti, koje na neki način zadire u poimanje nacionalnog suvereniteta.
Abstract (english)
The principle of supremacy is one of the fundamental principles on which the entire legal system of the European Union is based. The supremacy of EU law has had a substantial influence on the constitutional orders of EU Member States. Each Member State who whants to become part of the european family, has to implement the acuquis communautaire. The principle of supremacy suggests that in the case of conflict between national norm of a Member State and norms of European law, the EU law has the advantage. Therefore, its fundamental goal is to assure a unified and effective application of EU law in all Member States. It is established by the case law of the Court of Justice of the European Union. The aims of the Union could not be achieved without the principle of supremacy, which in some ways affects the understanding of national sovereignity.
