Abstract
Tema ovog diplomskog rada je „Naknada štete zbog tjelesne ozljede prouzročene prometnom nezgodom“. Rad će prije svega analizirat institut naknade štete te definirat tjelesnu ozljedu i njezine vrste. Potom će rad spomenuti općenite navode u svezi prometne nezgode. Fokus rada jet poglavlje koje se tiče naknade štete. Rad će prije svega obraditi osnove odgovornosti za štetu i njezine pretpostavke. Potom će rad svaku pretpostavku detaljno analizirati. Nakon toga, rad će obraditi ugovornu i izvanugovornu odgovornost za štetu. Postupak u slučaju prometne nezgode također će se obraditi u kontekstu rada. Rad će detaljno obraditi postupak naknade neimovinske štete. Detaljno će analizirati postupanje suda kod neimovinskih šteta te će navesti koje vrste neimovinskih šteta postoje prema pozitivnim propisima i koji su oblici popravljanja istih. Orijentacijski kriteriji i iznosi za utvrđivanje pravične novčane naknade neimovinske štete će se detaljno analizirati kao i svi koraci u postavljanju tužbenog zahtjeva za naknadu neimovinske štete.
Abstract (english)
The topic of this thesis is "Compensation for damage due to bodily injury caused by a traffic accident." The paper will primarily analyze the institute of compensation and define bodily injury and its types. The paper will then mention general allegations regarding traffic accidents. The focus of the work is the jet chapter concerning damages. The paper will primarily deal with the basics of liability for damage and its assumptions. The paper will then analyze each assumption in detail. After that, the paper will process contractual and non-contractual liability for damages. The accident procedure will also be dealt with in the context of the work. The paper will elaborate on the procedure for compensation of non-property damage. It will analyze in detail the court's treatment of non-pecuniary damages and will state which types of non-pecuniary damages exist according to the positive regulations and what are the forms of repairing them. Orientation criteria and amounts for determining fair monetary compensation for non-pecuniary damage will be analyzed in detail as well as all steps in filing a claim for compensation for non-pecuniary damage.
