Abstract
Tema ovog diplomskog rada je „Odgovornost za ekološke štete“. Rad će se prije svega fokusirati na općeniti pojam okoliša, suvremeno shvaćanje istog, njegovu zaštitu te teorije koje se njime bave. Slijedom navedenog, rad će obraditi pravo okoliša, njegove izvore te osnovna načela prema hrvatskom pozitivnom zakonodavstvu. Nastavno na prednje, rad će pomnije obraditi ona načela koja se tiču odgovornosti za ekološke štete. Središnji dio rada obraditi će pretpostavke i pravnu osnovu odgovornosti za štetu te će raščlaniti ugovornu od izvanugovorne odgovornosti za štetu. U nastavku, rad će obraditi institut imisija te će ukratko navesti i osnovna obilježja kaznenopravne zaštite okoliša. U konačnici, rad će se detaljno osvrnuti na praksu hrvatskih sudova kao i sudova Europske unije kako bi prednje navedene institute pomnije istaknuo i objasnio u praksi.
Abstract (english)
The subject of this graduate thesis is "Liability for environmental damage". The paper will primarily focus on the general notion of the environment, its contemporary understanding, its protection, and the theories that deal with it. Consequently, the paper will address environmental law, its sources and basic principles according to Croatian positive legislation. Going forward, the paper will more closely address those principles regarding liability for environmental damage. The central part of the work will deal with the assumptions and the legal basis of liability for damages and will separate the contractual from non-contractual liability for damages. Below, the paper will cover the imission institute and briefly outline the basic features of environmental criminal justice. Finally, the paper will look in detail at the practice of the Croatian courts as well as the European Union courts in order to highlight and explain the above mentioned institutes in practice.
