Abstract
Naslov, kao i tema ovoga rada je „ Neimovinska šteta u osiguranju od automobilske odgovornosti“. Nakon što ću utvrditi pojam neimovinske štete sukladno hrvatskom pravu, osvrnut ću se na pravo osobnosti čija povreda predstavlja neimovinsku štetu. Navesti ću koja sve prava osobnosti postoje te na koji način možemo popraviti nastalu neimovinsku štetu. Također, odgovorit ću na pitanje kako odlučiti o visini novčane naknade za neimovinsku štetu i kojim sve kriterijima i mjerilima se pri toj procjeni moramo služiti. Isto tako, upozorit ću na najčešće probleme u praksi kod naknade neimovinske štete. Nadalje, objasnit ću važnost uvođenja obveznog osiguranja od automobilske odgovornosti, koja je njegova uloga i osvrnut ću se na njegovo značenje kod naknade štete. Na kraju, navesti ću osobe koje sukladno zakonima imaju pravo na naknadu štete u osiguranju od automobilske odgovornosti te koje osobe nemaju takvo pravo.
Abstract (english)
The title, as well as the subject od this paper is „ The immaterial Damage in the Car Liability Insurance“. After I have established the concept od immaterial damage in accordance with Croatian law, I will refer to personality rights whose violation constitutes immaterial damage. I will state which personality rights exist and how can we redress the immaterial damage. Also, I will answer the question of how to decide on the amount of pecuniary compensation for immaterial damage and what criteria we must use in this assessment. I will also point out the most common problems in practice with compensation for immaterial damage. Furthermore, I will explain the importance of implementing the car liability insurance, its role and meaning in the compensation for the immaterial damage. In the end, I will list the persons who, in accordance to the law, are entitled to compensation and who do not have such a right.
