This paper will primarily analyse the system of liability of spouses for obligations to third parties. In the first part of this paper will be given a brief overview of the historical development of the arrangement of the property relations of the spouses in Croatian law along with analysation of the principles on which property relations of the spouses are based today. Furthermore, the legal system and contractual arrangement of the property relationships of the spouses as well as appropriate analysis of the institute of matrimonial property and own property shall be justified. Moreover, the types of responsibilities of the spouses for the obligations they have made in relation to third parties during the matrimonial union will be explained. Also, a brief review on the arrangement of property relationships between extramarital communities and the life partnerships of persons of the same sex will be given. Part of the work is also dedicated to the analysis of property relations and the system of arranging the responsibilities of spouses in Slovenian law as well as analysis of legal solutions and examples in case-law in Croatian and Slovenian law. At the very end of the work, existing legal deficiencies together with possible solutions related to the issue of liability of spouses to third parties will be presented.
