Abstract Namjera pisanja ovoga rada bila je prikazati način na koji hrvatsko zakonodavstvo jamči zaštitu
i ostvaruje načelo jednakoga postupanja i zabrane diskriminacije i to u privatnopravnom odnosu
do kojega dolazi između diskriminatora kao štetnika, koji se najčešće javlja u ulozi poslodavca
oštećene osobe, te diskriminirane osobe kao oštećenika, žrtve, odnosno osobe koja se javlja u
ulozi zaposlenika štetnika. U radu je, nadalje, osim navođenja raznih izvora unutar kojih je
zajamčena zabrana diskriminacije, prikazano i uređenje zabrane diskriminacije u
privatnopravnim odnosima u Europskoj uniji te usporedba sa uređenjem u dva temeljna zakona,
točnije Zakonom o suzbijanju diskriminacije i Zakonom o ravnopravnosti spolova. Također, u
radu su prikazani i mogući pojavni oblici diskriminacije razrađeni kroz primjere, a u svrhu
lakšeg razumijevanja razlikovanja pojavnih oblika diskriminacije. Pritom, posebna je pažnja
posvećena uređenju zaštite od diskriminacije u slučaju njezina pojavljivanja na osnovi dobi,
invaliditeta, spolne orijentacije, rasne i etničke pripadnosti te nacionalnosti. Na kraju su rada
razrađeni slučajevi u kojima se nepovoljnije postupanje neće smatrati diskriminacijom, točnije
iznimke od zabrane diskriminacije, te na koje sve načine oštećena osoba može ostvariti zaštitu
od diskriminatornog postupanja, bilo prije nego li dođe do takvog postupanja, bilo nakon pojave
diskriminatornog postupanja. Važnu ulogu pritom imaju sudska zaštita unutar koje oštećena
osobe može postaviti individualnu tužbu sudu kojom može zahtijevati utvrđenje da je došlo do
diskriminacije, zabranu ili otklanjanje diskriminacije, naknadu imovinske i neimovinske štete
te objavu presude kojom je utvrđena povreda prava na jednako postupanje u medijima, zatim
privremene mjere, kazne za prekršajnu odgovornost, pučki pravobranitelj i posebni
pravobranitelji, točnije pravobraniteljice te institut udružne tužbe.
Abstract (english) The intention of writing this paper was to show the way in which Croatian legislation guarantees
protection and achieves the principle of equal treatment and prohibition of discrimination in
private law between the discriminator as injurer, which most often occurs in the role of
employer of the injured party, and discriminated person as injured party, the victim, ie the
person appearing in the role of the employee of the injurer. In addition to citing various sources
within which the prohibition of discrimination is guaranteed, the paper also presents the
regulation of the prohibition of discrimination in private law relations in the European Union
and a comparison with the regulation in two basic laws, namely the Anti-Discrimination Act
(ADA) and the Gender Equality Act (GEA). Also, the paper presents possible forms of
discrimination elaborated through examples, in order to facilitate the understanding of the
distinction between manifestations of discrimination. In doing so, special attention is paid to
the regulation of protection against discrimination in the event of its occurrence on the basis of
age, disability, sexual orientation, racial and ethnic affiliation and nationality. At the end of the
paper, cases are elaborated in which less favorable treatment will not be considered
discrimination, more precisely exceptions to the prohibition of discrimination, and in which
ways the injured person can obtain protection from discriminatory treatment, either before such
treatment or after the occurrence of discriminatory treatment. An important role is played by
judicial protection, within which the injured party can file an individual lawsuit in court
requesting a finding of discrimination, prohibition or elimination of discrimination,
compensation for property and non-pecuniary damage and publication of a verdict finding a
violation of equal treatment in the media, then temporary measures, penalties for misdemeanor
liability, the Office of the Ombudsman and offices od special ombudspersons, ie
ombudswomen, and the institute of a joint lawsuit.
