Abstract (croatian)
Od hrvatskog Ustava iz 1990. (NN, 56/90), koji je na bitno drugačiji način regulirao ustroj i položaj sudbene vlasti u Republici Hrvatskoj, sustavno se radi na daljnjoj reformi, razvoju i unaprjeđenju stanja u sudstvu. Ipak loši procesni parametri, među ostalim, i u stečajnim te ovršnim postupcima naveli su zakonodavca da počne promišljati pa i provoditi postupak njihove dejudicijalizacije. Ovaj rad ima za cilj analizirati navedeni postupak, odgovarajući na pitanje – gdje smo i šta dalje na planu u dejudicijalizaciji stečajnih i ovršnih postupaka? Kompleksnost predmeta istraživanja i postavljeni zadaci uvjetovali su izbor metoda pa je u istraživanju prvenstveno korišten povijesno-pravni i normativno-pravni metodološki pristup.
Abstract (croatian)
Since the 1990 Constitution of the Republic of Croatia (NN, 56/90), which regulated the organization and the position of the judiciary in the Republic of Croatia in a significantly different way, legislator is constantly working on further reform, development and improvement of the situation in the judiciary. However, the length of court proceedings have prompted the legislator to begin to deliberate and to implement the process of dejudicijalization of the protection of civil rights and obligations. The purpose of this paper is to analyze the results of the existing dejudicijalization procedures so far as to answer the question: Where are we and what is further on the plan of dejudicijalization of the protection of civil rights and obligations in general and special execution procedures? The complexity of the subject matter of the research and the set tasks required the choice of methods, so the author primarily used a historical and normative methodological approach.
