Abstract
Diplomski rad pisan je na temu izvanparničnog prava, prvenstveno u kontekstu novog zakona. Obzirom na dosta usko područje koje pokriva ova tema, rad se dotiče povijesnog razvoja izvanparničnog prava na području RH te relevantnih propisa koji su usko povezani sa samim zakonom. Nastoji se stvoriti kratki pregled izvanparničnog prava Republike Hrvatske kako bi se stvorila svojevrsna pozadinska slika za analizu novog zakona koja dolazi kasnije u radu. Komentirati će se prvo stari zakon koji je donedavno bio na snazi a seže gotovo 90 godina u povijest, konkretno u povijest „prve Jugoslavije“ odnosno, Kraljevine Jugoslavije. Zatim ćemo se dotaknuti novog Zakona o izvanparničnom postupku koji je stupio na snagu 10. lipnja 2023. godine. Usporedit će se nova i stara rješenja te preispitati nužnost donošenja novog zakona.
Abstract (english)
The thesis was written on the topic of non-litigation law, primarily in the context of the new law. Considering the rather narrow area covered by this topic, the paper touches on the historical development of non-litigation law in the territory of the Republic of Croatia and relevant regulations that are closely related to the law itself. An attempt is made to create a brief overview of the non-litigation law of the Republic of Croatia in order to create a kind of background image for the analysis of the new law that comes later in the paper. First, the old law that was in force until recently and goes back almost 90 years in history, specifically in the history of the "first Yugoslavia", that is, the Kingdom of Yugoslavia, will be commented. Next, we will turn our attention to the new Law on non-litigation proceedings, which entered into force on June 10, 2023. New and old solutions will be compared and the necessity of passing a new law will be re-examined.
