Abstract
Uredba (EU) br. 655/2014 Europskog parlamenta i Vijeća od 15. svibnja 2014. o uspostavi postupka za europski nalog za blokadu računa kako bi se pojednostavila prekogranična naplata duga u građanskim i trgovačkim stvarima donesena je kako bi se očuvale i razvijale sigurnost, pravednost i sloboda glede slobodnog kretanja osoba te naplate potraživanja. Upravo putem predmetnog naloga za blokadu računa vjerovnik dobiva zaštitnu mjeru i mogućnost prekogranične naplate svojeg potraživanja. Prilikom izdavanja naloga potrebno je poštivat odredbe Uredbe te vjerovnik treba znati koje su njegove odgovornosti. Sadržaj naloga detaljno je propisan i dostupan za preuzimanje mrežnim putem. Jednom kada se donese odluka o svezi zahtjeva za nalog isto se prosljeđuje nadležnom tijelu u državi provoditeljici na postupanje, a sve u cilju naplate vjerovnikovog potraživanja od dužnika.
Abstract (english)
Regulation (EU) no. 655/2014 of the European Parliament and of the Council of 15 May 2014 establishing a procedure for a European Account Blocking Order to simplify cross-border debt collection in civil and commercial matters was adopted to preserve and develop security, fairness and freedom of free movement person who collects claims. It is through the account blocking order that the creditor receives a protective measure and the possibility of cross-border collection of his claim. When issuing an order, it is necessary to comply with the provisions of the Regulation, and the creditor should know what his responsibilities are. The content of the order is prescribed in detail and is available for download online. Once a decision is made regarding the request for an order, it is forwarded to the competent authority in the executing state for action, all with the aim of collecting the creditor's claim from the debtor.
