Abstract
Predmet ovog diplomskog rada je analiza povijesnog razvoja rimskog ugovora o zajmu te njegova usporedba sa istoimenim ugovorom u hrvatskom suvremenom pravu. Posebna pozornost posvećena je razradi prava i dužnosti ugovornih strana, karakteristikama predmeta ugovora o zajmu, načinu osiguranja i prestanka obveze iz zajma te posebnim oblicima ovog ugovora. Autor kroz rad donosi detaljnu analizu karakteristika ugovora o zajmu rimskoga prava istovremeno uspoređujući rimska rješenja sa onima hrvatskog suvremenog prava.
Abstract (english)
The subject of this thesis is the analysis of the historical development of the Roman loan agreement and its comparison with the agreement of the same name in Croatian contemporary law. Special attention is paid to the elaboration of the rights and obligations of the contracting parties, the characteristics of the subject of the loan agreement, the manner of securing and terminating the obligation from the loan and the special forms of this agreement. Through the paper, the author provides a detailed analysis of the characteristics of the Roman law loan agreement, at the same time comparing Roman solutions with those of Croatian contemporary law.
