Abstract Trenutno važeći Ovršni zakon je doživio svoje brojne izmjene i dopune. Posljednje
izmjene bile su vezane uz izmjene odredbi u kojima se iznosi u kunama pretvaraju u eure, a
zakon je stupio na snagu na dan uvođenja eura kao službene valute u Republici Hrvatskoj,
odnosno 01. siječnja 2023. godine. Poslodavci i Hrvatski zavod za mirovinsko osiguranje
predlažu da ovrhe na plaći, odnosno mirovini provodi samo FINA, bez mogućnosti uplitanja u
postupak ovrhe sudova te javnih bilježnika. Prilikom utvrđivanja ograničenja i izuzeća
prilikom provedbe ovrhe na plaći ovršenika mora se uzeti u obzir načelo zaštite dostojanstva
ovršenika. Kada su u pitanju ograničenja u 2023. godini gledamo prosječnu mjesečnu
isplaćenu neto plaću po zaposlenome u pravnim osobama Republike Hrvatske za razdoblje
siječanj-kolovoza 2022. koju objavljuje Državni zavod za statistiku i ona po preračunu u eure
po fiksnom tečaju konverzije 1EUR= 7,53450 iznosi 1.0006,44 EUR-a i ono je relevantan
iznos za provedbu ovrhe na plaći u 2023. godini. Na iznos plaće koji se smije ovršiti, odnosno
na koji su poslodavci obvezni provesti ovrhu, primjenjuje se odredba članka 173. OZ-a.
Izmjenama 2012. i 2015. godine je dodano 15 točki kojima je proširen broj zaštićenih
primanja, a cilj im je osiguranje novčanih sredstava za zadovoljenje osnovnih životnih potreba
ovršenika i kojom se ispunjava načelo dostojanstva. Članak 172. taksativno navodi novčana
primanja, dok je u članku 173. razrađen institut ovrhe.
Osim pozitivnih pretpostavljenih učinaka uvođenja eura kao službene valute u
Republici Hrvatskoj kao što su smanjenje rizika za financijsku i makroekonomsku stabilnost,
nestanak izloženosti građana mogućim valutnim krizama, veća transparentnost cijena što
potiče međunarodnu trgovinu i turizam. Pozitivan utjecaj ima i na investicije. Međutim,
trenutno povećanje cijena i usluga i to od 20% - 50% posljedično dovodi do smanjenja
kupovne moći građana s obzirom da je do povećanja plaća došlo minimalno odnosno nikako.
Abstract (english) The current Enforcement Act has undergone its numerous amendments. The latest
changes were related to changes to the provisions in which the amounts in kuna are converted
into euros, and the law entered into force on the day of the introduction of the euro as the
official currency in the Republic of Croatia, or January 1, 2023. Employers and the Croatian
Pension Insurance Institute propose that foreclosures on salary, ie pension, be carried out only
by FINA, without the possibility of interfering in the procedure of enforcement of courts and
notaries. The principle of protecting the dignity of the bailiff must be taken into account when
determining restrictions and exemptions when implementing enforcement on the salary of the
bailiff. When it comes to restrictions in 2023, we look at the average monthly paid net salary
per employee in legal entities of the Republic of Croatia for the period January-August 2022.

In addition to the positive presumed effects of the introduction of the euro as the
official currency in the Republic of Croatia, such as reducing the risk to financial and
macroeconomic stability, the disappearance of citizens' exposure to possible currency crises,
greater price transparency that encourages international trade and tourism. It also has a
positive impact on investments. However, the current increase in prices and services of 20% -
50% consequently leads to a reduction in the purchasing power of citizens, given that the
increase in wages has occurred minimally or by no means.
