Abstract
U ovom će se radu obraditi institut referenduma uz njegove prednosti i nedostatke, uz poseban osvrt na građanske inicijative. Istaknut će se praksa građanskih inicijativa uz pregled dosadašnjih građanskih inicijativa, te novo uređenje referenduma prema Konačnom prijedlogu Zakona o referendumu. Sagledat će se uloga Ustavnog suda o referendumskom odlučivanju te njegovo djelovanje prema ustavotvornim referendumima. Nakon toga bavit ćemo se pitanjima u vezi referenduma o braku i referendumu o ograničenju ljudskih prava u izvanrednim stanjima uz analizu suvišnosti ustavnih amandmana kao i preispitivanje odluke Ustavnog suda.
Abstract (english)
This paper will discuss the advantages and disadvantages of the referendum, with particular regard to citizens' initiatives. The practice of citizens' initiatives will be highlighted along with an overview of citizens' initiatives so far, and its regulation according to the Final Proposal of the Referendum Law. The role of the Constitutional Court on referendum decision-making and its action in relation to constitutional referendum will be reviewed. After this, we will deal with issues related to the referendum on marriage and the referendum on the restriction of human rights in states of emergency, and determine whether, with an analysis of the redundancy of constitutional amendments, as well as a review of the decision of the Constitutional Court.
