Abstract Globalni ekonomski trendovi nezaustavljivi su kao i s njima povezana transformacija rada. Moderna politika poslovanja poduzeća na tržištu rada temelji se na kontinuiranoj konkurenciji radi sjecanja dodatne imovinske vrijednostim a ujedno predstavlja uzrok restrukturiranja radne snage, erozije socijalnih standarda i smanjenja radnopravne zaštite radnika što konačno može dovesti do destabilizacije gospodarstva i društva u cjelini. S ciljem stvaranja profita, poduzetnici sve češće manipuliraju radnicima korištenjem kreativnih i vremenski ograničenih atipičnih oblika zapošljavanja kako bi izbjegli radnosocijalnu i fiskalnu odgovornost. Prilagodba na tržišne promjene navedenim modelima zapošljavanja utječe na visoku incidenciju prekarnoga rada uz koji se vezuje visoka razina nesigurnosti i nestabilnosti. Rad ima za cilj produbiti saznanje o uzrocima i posljedicama prekarnosti. S tim u vezi, zbog velikog broja radnika koju obavljaju poslove na različitim nestandardnim ugovornim osnova i složenosti stvaranja reprezentativnog uzorka istraživanje se ograničava na užu ciljanu skupinu radnika. Dakle, u kontekstu ekspanzije nestandardnog rada i njegovog utjecaja na pojavu i status novog, prekarnog radnika predložena disertacija nastoji analizirati obilježja prekarnosti „klasičnih“ nestandardnih oblika rada– ugovora o radu na određeno vrijeme, rada posredstvom agencija za privremeno zapošljavanja, studentskog rada te u manjem dijelu rada s nepunim radnim vremenom - u hrvatskom pravu i praksi te predložiti rješenja de lege ferenda kojima bi se ona mogla ukloniti ili ublažiti.
Izostanak jasnih odredbi hrvatskog radnopravnog zakonodavstva često dovodi do primjene metode kategorizacije nestandardnih oblika rada pod drugu pravnu osnovu, što dovodi do zloupotrebe atipičnih oblika rada. U radu se ispituje učinkovitost pravnih rješenja izdvojenih država članica EU kojim bi se hrvatski zakonodavac mogao rukovoditi prilikom noveliranja sveobuhvatnog modela zaštite radnika.
Predložena disertacija u određenoj mjeri posvećuje pozornost važnosti uloge sindikalne zajednice koja u svijetu rastuće fleksibilizacije tržišta rada sve više slabi. Vodeći se strategijom uključivosti, sindikati (odnosno mehanizmi kolektivne zaštite radničkih prava) imaju mogućnost pružiti adekvatnu pravnu zaštitu prekarnim radnicima, i to ne samo onima koji rad obavljaju u okvirima nestandardnih radnih aranžmana, nego i u standardnom radnom odnosu, s obzirom da je rizik od prekarnosti karakteristika inherentna svim oblicima zapošljavanja.
Abstract (english) Labour market is facing unconstrained global economic trends and transformation of work. To gain an added value the contemporary company business policy is based on continuous competition causing restructuring of labour force, erosion of social standards and reduction of workers protection which consequently destabilizes the economy and society in general. In order to generate profits, enterprises are increasingly manipulating workers through creative and time-limited non-standard forms of employment to avoid labour, social and fiscal responsibility. Following global and European trends, Croatia seeks to respond to the challenges of low participation in the labour market and high unemployment rates trough application of non-standard work. Adapting to labour market changes using this type of deregulated instruments resulted with high incidence of precariousness in employment in all its various manifestations. Nevertheless, the absence of clear Croatian labour law provisions often leads to the categorization of non-standard forms of employment under various positive labour law grounds as a method that creates a niche for abuse of atypical forms of employment. In this regard, due to the large number of workers who perform work on various non-standard contractual bases and the complexity of creating a representative sample, the research is limited to a narrower target group of workers. In the context of the expansion of non-standard work and its impact on the appearance and status of a new, precarious worker, the proposed dissertation tries to analyze the features of the precariousness of "classic" non-standard forms of work - fixed-term work contracts, temporary agency work, student work and to a lesser extent part of part-time work - in Croatian law and practice, and to propose de lege ferenda solutions by which it could be removed or mitigated.
In the context of the expansion of non-standard employment and the precarious position of new worker performing work in low-quality jobs, the proposed dissertation seeks to quantitatively analyse respectively map the magnitude of usage of so-called „classic“ atypical forms of work and identify innovative forms of employment present in Croatian labour market using statistic and comparative method. The research de lege ferenda examines the legal solutions of selected EU member states that could be used as guideline in the process of redefining the Croatian regulatory framework when amending the comprehensive model of protection for workers on the labour market.
Furthermore, in some extent proposed dissertation strives to raise the awareness about importance of trade unions which in the world of increasing labour market flexibility is losing its meaning. When engage in an inclusive strategy, unions have the opportunity to provide adequate legal protection for precarious workers who perform profitable work within the standard employment relationship and atypical employment arrangements, given that they are at risk of precariousness as an inherent characteristic of all forms of employment.
