Abstract | Koncept odgovornosti države u praksi je veoma često i složeno pitanje. Kada se taj koncept stavi u kontekst zločina onda njegovo značenje poprima širu dimenziju. Kroz rad će biti prikazani dokumenti koji propisuju uvjete za postojanje odgovornosti države te sukladno tome posljedice utvrđene odgovornosti. Analizirana sudska praksa međunarodnih, regionalnih i nacionalnih sudova upotpunit će teorijska stajališta instituta odgovornosti države i to ponajprije kroz razradu testova kontrole primjenjivih prilikom dokazivanja postojanja odgovornosti države. Bit će predstavljen i razrađen zakonodavni okvir Republike Hrvatske kojim je uređen institut odgovornosti države, s posebnim naglaskom na okolnosti ratnih zbivanja. Zaključno, pitanje žrtava, njihovih prava i načina obeštećenja upotpunit će cjelokupni prikaz koncepta odgovornosti države u kontekstu ratnih zločina. U tu svrhu bit će analizirani dosadašnji napori glede utvrđivanja statusa i prava žrtava rata kroz zakonske akte, programe i druge inicijative, s posebnim osvrtom na stanje u zemljama bivše Jugoslavije. Predočeni će biti nedostaci postojećih programa i inicijativa te preporuke glede poboljšanja statusa žrtava u postratnom životu. |
Abstract (english) | The concept of state responsibility represents very common and complex issue. The meaning of that concept, when placed in the context of war crimes, takes broader dimension. In this paper will be presented documents that prescribe conditions for existence of state responsibility, and according to that, consequences of the liability. Analysed case-law of international, regional and domestic courts will fulfill theoretical views of the institute of the state responsibility, especially over the elaboration of the control tests applied during the process of proving the existence of state responsibility. In the paper will be be presented and elaborated legislative framework of the Republic of Croatia, whose norms regulates concept of state responsibility, with the accent on the circumstances on war events. Last, but not the least, the question of victims, their rights and ways of compensation, will complete the entire view of the concept of state responsibility in the context of war crimes. For that purpose, the efforts that has already been done, regarding the determination of status of victims and their rights through legal acts, programs and other initiatives, will be analysed. The special emphasis will be given to the situation in the countries from the former Yugoslavia. Also, there will be demonstrated shortcomings of the existing programs and initiatives as well as the recommendations with regard to the improvement of status of victims in the life after war. |
