Abstract
Postoji određeni broj zaljeva koji su znatno veće konfiguracije, tj. šireg ulaza, koje obalne države proglašavaju svojim unutrašnjim morskim vodama suprotno općim međunarodnim pravilima, ističući pritom postojanje historijskog naslova nad njima. Riječ je o institutu historijskog zaljeva. Nad vodama takvih zaljeva obalne države vrše efektivnu suverenost, koja mora biti dugotrajna i kontinuirana te vršena uz odsutnost protivljenja drugih država. S obzirom na manjak političke volje međunarodne zajednice, institut historijskih zaljeva nije definiran dvjema donesenim konvencijama iz 1958. te 1982. godine, već je razvitak samog instituta potrebno pratiti u okviru međunarodnog običajnog prava. Također, prilikom analize instituta važno je obratiti pozornost na dvije provedene studije, 1958. te 1962. godine, pri Ujedinjenim narodima kojima se nastojalo odrediti konstitutivne elemente instituta historijskih zaljeva. Nadalje, važno je pitanje tereta dokaza u odnosu na postojanje historijskog naslova, odnosno hoće li to biti na strani koja ističe postojanje historijskog prava ili će se teret nalaziti na onim državama koje se protive takvom vršenju suverenosti. Analizom sudske prakse, odnosno prakse Međunarodnog suda, Stalnog Arbitražnog suda te Centralnoameričkog suda bit će riječi o najpoznatijim zaljevima za koje postoji generalni konsenzus međunarodne zajednice oko pitanja njihovog statusa kao historijskih zaljeva.
Abstract (english)
There is a certain number of bays which have a considerably larger configuration, viz. the width of their mouth, which the Coastal States, contrary to the generally applicable rules of international law, claim as their internal waters. It is about historic bays over which the Coastal States effectively, continuously and over a long period of time exercise their sovereignty with the acquiescence of the other States. Considering the lack of political will of international community, the question of historic bays was not defined in 1958 Convention nor in 1982 UN Convention on the Law of the Sea. Hence, development of the historic bays is necessary to observe through international common law. Namely, it is crucially to pay attention to both UN Studies enacted in 1958th and 1962nd which were trying to establish three essential elements for historic bays. Likewise, the burden of proof is essential in regard to the existence of the historic title. Therefore there is a need to answer a question on which side is the onus of proof. Through case law analysis, precisely practice of International Court of Justice, Permanent Court of Arbitration and Central American Court of Justice, there shall be listed most-known bays which are generally recognized as historic bays.
