Abstract Doktorska disertacija Pravna pitanja elektroničkog plaćanja u uvodnom dijelu prikazuje i obrađuje pojam i vrste elektroničkog plaćanja i kratko otvara pitanje jesu li svi oblici novca koji se pojavljuju kod elektroničkog plaćanja ujedno i zakonsko sredstvo plaćanja. Ujedno je podjela elektroničkog plaćanja na tri vrste - okviru elektroničkog bankarstva, elektroničkim nocem i virtualnim valutama - odredila daljnje strukturiranje disertacije. Naime, nakon navođenja pravnih izvora i prikaza platnih instrumenata koji mogu biti prisutni kod sve tri navedene vrste elektroničkog plaćanja i koji ih povezuje, u zasebnim dijelovima prikazuje se i analiziraju elektroničko plaćanje u okviru elktorničkog bankarstva U kojem se rabi žiralni novac), elektronički novac i plaćanja tim novcem i virtualne valute i plaćanje tim valutama. U svakom od tih dijelova prikazuju i obrađuju se tehničke i pravne pretpostavke, pravni položaj i pravni odnosi subjekata prema važećem hrvatskom pravu, ali i prikazuju rješenja u
poredbenom pravu, odnosno u njemačkom pravu, pravu Velike Britanije, pravu u SAD-u i pravu
Bosne i Hercegovine, koji su uzeti kao reprezentanti kontinentalnoeuropskog u okviru EU,
anglosaksonskog i kontinentalnoeuropskog izvan okvira EU, pravnog kruga. Posebna pažnja
posvećena je kvalifikaciji odnosa strana kod elektroničkog plaćanja sa stajališta obveznog prava,
kod koje se ti odnosi uspoređuju s odnosima kod imenovanih tipova ugovora i utvrđuju pravila
tih tipova ugovora koja se mogu primijeniti kod pojedinih odnosa, a koja ne mogu, odnosno koji
odnosi odgovaraju nekom tipu imenovanih ugovora, a koje treba ocijeniti kao odnose sui
generis. I u tim dijelovima disertacije i u zaključcima također se iznose ocjene propisa koji
uređuju elektronička plaćanja, uočava u prvom redu njihova nedostatna spojivost s općim
pravilima obveznog prava, ali i drugi nedostaci, i iznose prijedlozi de lege ferenda. Posebno se
izlažu zaključci o odnosu pojedinih oblika novca i zakonskog sredstva plaćanja.
Abstract (english) ln its introductory section, the doctoral thesis „Legal lssues of Electronic Payment"
constructs the definition of electronic payment and maps the various categories of payments
in this field. lt furthermore briefly opens the question if all types of money that appear in the
sphere of electronic payment a Iso represent legal tender. The general structuring of electronic
payment into electronic banking, electronic money and virtual currency then determined the
further structure of the thesis. Namely, after mentioning the legal sources and describing the
payment instruments, which can be used in ali 3 categories of electronic payments and which
connect them, in separate chapters the modalities of payment within the spheres of electronic
banking (in which deposit money is used), electronic money and virtual currency are analysed.
ln each chapter both technical and legal preconditions, the legal position and the legal relations
under current Croatian law, as well as comparative law solutions under the law of Germany,
the UK, the USA and Bosnia & Herzegovina, which were chosen to give an overview of civil law
and common law solutions, respectively within and outside of the EU . Special attention is given
to the qualification of the legal relations amongst parties from the perspective of the law of
obligations, in the way that the relations are compared to statutory explicitly defined contracts
and where appropriate subsumed under them, or alternatively defined independently as
contractual relations sui generis. Both in this part, as well as in the concluding part of the thesis,
the current legislation on electronic payment is assessed and especially critically evaluated
when it comes to its compatibility with the rules of the general law of obligations and other key
issues, for which de lege ferenda solutions are proposed. Finally, conclusions regarding the
particular types of money and legal tender are presented.
