Abstract
Ugovor o kupoprodaji jedan je od značajnijih ugovora rimskog, ali i modernog prava, a njegova važnost je naglašena činjenicom da je imao i ima vrlo široku primjenu tijekom čitave rimske povijesti, kao i danas. Osim prikaza povijesnog razvoja i temeljnih značajki kupoprodajnog ugovora, u radu se primarno tematizira položaj vjerovnika u kupoprodajnom ugovoru. Budući da i kupac i prodavatelj istodobno imaju status dužnika i vjerovnika, kroz rad će se pružiti analiza prava i obveza ugovornih stranaka, s posebnim naglaskom na problematiku zakašnjenja dužnika i vjerovnika, a istaknut će se i nekoliko akcenata s obzirom na problematiku kapare, kao i mogućih uzgrednih sastojaka kupoprodajnog ugovora, sve s ciljem definiranja položaja vjerovnika u kupoprodajnom ugovoru.
Abstract (english)
The sale-purchase contract is one of the most significant contracts of Roman law, as well as of modern laws and its importance is emphasized by the fact that it had very wide application throughout Roman history as it has today. In addition to the historical development and the basic features of the sale-purchase contract, the paper deals primarily with the position of the creditor in this contract. Since both the buyer and the seller have the status of debtor and creditor at the same time, an analysis of the rights and obligations of the contracting parties will be provided through the work, with particular emphasis on debtor´s and creditor´s delay and several accents will be highlighted with regard to the issue of possible alternative components of a sales contract, all with a scope to define the position of creditor in this contract.
