Abstract
Predmet ovog rada je ukidanje egzekvature prema Uredbi Bruxelles I bis. Prema navedenoj Uredbi, kada je riječ o sudskoj odluci porijeklom iz druge države članice EU-a, umjesto da stranka mora zatražiti proglašenje njezine ovršivosti, ta odluka je neposredno ovršna u svim drugim državama članicama. Ta stranka, kada želi zatražiti ovrhu sudske odluke treba zatražiti od suda porijekla da izda potvrdu o ovršivosti i u njoj navede pojedinosti o toj sudskoj odluci. U tom su slučaju potvrda i preslika sudske odluke dovoljni za ovrhu sudske odluke u zamoljenoj državi članici. No, iako je postupak egzekvature ukinut, zadržane su neke zaštitne mjere, u obliku razloga za odbijanje ovrhe, koje su detaljnije objašnjene kroz sudsku praksu Suda EU-a.
Abstract (english)
The subject of this paper is the abolition of exequatur pursuant to the Brussels I bis Regulation. In accordance with the said Regulation, when it comes to a judicial decision originating from another EU Member State, instead of requiring a party to declare its enforceability, that decision is directly enforceable in all other Member States. When a party wishes to request enforcement of a judgment, the party has to ask the court of origin to issue a certificate of enforceability and state in it the details of that judgment. In this case, a certificate and a copy of the judgment are sufficient for the enforcement in the requested Member State. However, although the process of exequatur has been abolished, some safeguards have been retained in the form of reasons for refusing enforcement, which are explained in more detail by reference to the case law of the Court of Justice of the EU.
