Judgment based on the agreement off the parties is a new form of consensuality was introduced into Croatian law in 2008. although the predecessor of this institute was a judgment at the request of the parties in the investigation, which was introduced in the previous Criminal Procedure Act year of 2002. The base of this institute are found in the Anglo-American legal system. The introduction of this institute represents a big step in to the continental legal tradition, considering that for a long time in these areas was aversion to introduce it. At the beginning this paper deals with the comparasion of these two systems. Our legislator assumed that the introduction of consensuality in criminal procedural law, including judgment based on the agreement off the parties would significantly contribute to the efficiency of the judiciary and the rationalization and reduction of costs of criminal proceedings, while at the same time ensuring that the goals of general and special prevention are achived. The paper covers two stages in the process of making a judgment based on the agreement off the parties. The first takes place between state attorney and the defendant with the mandatory presence of the defender, while the second stage focuses on the role of the court after the agreement is presented. Legal science and judical practice indicate that this form of consensuality in addition to certain advantages also has certain shortcomings, which are particularly evident in the role of the defendant, the reduced authority of the court and in relation to the principles of criminal procedure.
