Criminal procedure is a set of actions regulated by the provisions of criminal procedural law, which are undertaken by the participants of that procedure in case of suspicion that a criminal offense has been committed, with the aim of establishing guilt and imposing a criminal sanction. In criminal proceedings, the three basic criminal procedure subjects perform three basic criminal procedure functions: the function of prosecution is performed by the authorized prosecutor, the function of defense is performed by the defendant and his defense attorney, and the court performs the function of trial. Croatian criminal procedural law recognizes three types of prosecutors: state attorney, subsidiary prosecutor and private prosecutor. The fundamental authority and main duty of the state attorney is the prosecution of perpetrators of criminal offenses for which criminal proceedings are initiated ex officio. It is an independent judicial body, whose powers, competences and scope are determined by law. As the holder of the function of prosecution, the state attorney is a party in criminal proceedings, who has the right to propose taking all the necessary procedural actions and to prove the facts in favor of the prosecution, from the beginning to the end of the criminal proceedings.
