Abstract
Cilj ovoga rada je definirati sam pojam ubrojivosti u kaznenom postupku, načine na koji se utvrđuje ubrojivost ili neubrojivost, te značaj psihijatara vještaka. Kazneni zakon ubrojivost određuje kao najvažniji sastojak krivnje. Biti ubrojiv znači biti sposoban za krivnju, pa neubrojiva osoba nije kriva. Ubrojivost predstavlja normalno psihičko stanje počinitelja ili stanje duševnog zdravlja počinitelja u vrijeme počinjenja djela. Ubrojivost se javlja kao pravilo pa se ono i pretpostavlja, a neubrojivost se javlja kao iznimka i ona se mora utvrđivati. Kazneni zakon Republike Hrvatske, kao i suvremena znanost, prihvaćaju mješovitu ili biološko-psihološku metodu utvrđivanja neubrojivosti. Također se objašnjava osnovna razlika među vrstama ubrojivosti i neubrojivosti, kao i njihove učinke u ostvarenju pravne sigurnosti.
Abstract (english)
The aim of this work is to define the very concept of countability in the criminal procedure, the ways in which countability or noncountability is determined, and the importance of expert psychiatrists. The Criminal Code defines countability as the most important component of guilt. To be countable is to be capable of guilt, so an uncountable person is not guilty. Countability represents the normal mental state of the perpetrator or the state of mental health of the perpetrator at the time of the crime. Countability appears as a rule, so it is assumed, and uncountability appears as an exception and must be determined. The Criminal Code of the Republic of Croatia, as well as modern science, accept a mixed or the biological-psychological method of determining uncountability. It also explains the basic difference between the types of countability and uncountability, as well as their effects in achieving legal certainty.
