Abstract
Protupravnost zauzima važno mjesto u kaznenom pravu jer predstavlja jedno od temeljnih obilježja kaznenog djela. Također, postoje i zakonski opisi kaznenih djela gdje je pojam protupravnosti izričito naveden u tom opisu. Protupravnost je ostvarenje bića kaznenog djela, tj. kršenje kaznenopravne norme na način koji je društveno štetan. No, u određenim slučajevima, protupravnost može biti isključena. U ovom završnom radu detaljno su analizirani neki razlozi isključenja protupravnosti, s naglaskom na nužnu obranu i krajnju nuždu. Naime, nužna obrana i krajnja nužda najučestaliji su razlozi isključenja protupravnosti, ali treba spomenuti i beznačajno djelo, dužnost izlaganja opasnosti, silu i prijetnju, isključenje protupravnosti prema međunarodnom ratnom pravu, zapovijed nadređenoga, pristanak oštećenika, prigovor savjesti. Navedene okolnosti također se javljaju kao razlozi isključenja protupravnosti, što je analizirano u nastavku rada.
Abstract (english)
Illegality occupies an important place in criminal law because it represents one of the fundamental circumstances of a criminal act. Also, there are legal descriptions of criminal offenses where the concept of illegality is explicitly stated in that description. Illegality is the realization of the essence of a criminal act, i.e. violation of the criminal law norm in a way that is socially harmful. However, in certain cases, illegality can be excluded. In this final paper, some reasons for the exclusion of illegality are analyzed in detail, with an emphasis on necessary defense and last resort. Namely, necessary defense and extreme necessity are the most frequent reasons for exclusion of illegality, but it should also be mentioned insignificant act, duty to expose danger, force and threat, exclusion of illegality according to the international law of war, order of a superior, consent of the injured party, conscientious objection. The aforementioned circumstances also appear as reasons for the exclusion of illegality, which is analyzed in the rest of the paper.
