The topic of this master's thesisis insurance for seafarers - repatriation. Seafarers' insurance and the issue of repatriation are regulated by the Maritime Labor Convention – commonly known as MLC, and repatriation is regulated by the MLC and the Maritime Code, although there was also a Convention on the Repatriation of Seafarers from 1926, which regulated this fundamental right of seafarers. The thesis constists of three parts:: the MLC, the repatriation of seafarers and the repatriation of seafarers during the COVID-19 pandemic. The paper begins with a presentation of general information about the MLC with special emphasis on its structure and content in order tounderstand the importance of this Convention for seafarers. It is a codified act that thoroughly analyses the rights of seafarers, compulsory insurance shipowners and financial guarantee. The MLC does not contain provisions relating to direct actions, contrary to the conventions such as the 1992 International Convention on Civil Liability for Oil Pollution Damage (CLC Convention) and the International Convention on Civil Liability for Bunker Oil Pollution Damage (Bunker Convention), but it does not challenge application of that institute. In particular, the concept of repatriation is presented in great detail, as one of the basic and most important rights entitled to every seafarer, with an emphasis on the radical changes that occurred with the amendments to the Maritime Code from 2011, comparing them with the changes that followed in 2019. Furthermore, the concept of travel expenses, the question of paying those expenses and the right of recourse are analyzed and defined in detail. The last section is dedicated to the repatriation of seafarers during the COVID-19 pandemic, with a special focus on the impact and consequences it caused on the mental and physical health of each seafarer.
