Historically, the right to strike presents one of the fundamental, and we could say the most important rights of workers. A strike is an instrument of protection of already existing rights, but also of improving the rights and interests of workers from employment. Given the apparently unequal position of the parties to the employment relationship, where throughout history the interests of employers have almost always dominated, the strike has proven to be one of the most effective means of realizing the desired goals of the workers. The fact that the strike is a constitutionally guaranteed right, and it is elaborated in more detail by other laws and bylaws, speaks of the importance of the strike and the right to strike in the modern legal order, and thus in the positive order in the Republic of Croatia. The initial part of the paper will discuss the strike as a conflicting way of resolving labor disputes and the development of the right and freedom to strike, while the central part of the paper discusses the assumptions of the legality of the strike. Finally, the final part of the paper deals with the strike and the issue of the legality of the strike of educators in the Croatia in 2019, as a strike that greatly shook, but also provoked the interests of the public.
