This paper deals with the role of a witness in a civil procedure based on the Civil Procedure Act of Republic of Croatia. It deals with the duties of a witness – witness's duty to respond when he had been duly summoned by the Court, his duty of complete and truthful testimony and an optional duty of taking an oath. It deals especially with the witness's ability to testify as well as with the limitations such as duty of official and military secrecy and possibility to exclamation of deposition or answering particular questions when it's estimated by the law. The second part elaborates the procedure of giving testimony based on the principal of oral proceedings with an overview of novelties about submitting of evidence in a preliminary hearing of civil procedure and possibility of usage od audiovisual devices in a procedure. It also deals with the subject of testimony and the role of the Court in the examination of the witness as well as the sanctions that can be imposed on the witness in case of breaking the rules about responding to the Court summon and testifying, especially in case of false testimony, The final part of the paper deals with the witness's right reimbursement of expenses for the duty performed.
