Sex discrimination is one of the forms of discrimination. It is read and based on whether a person is a man or a woman. Gender discrimination can be direct or indirect, as well as positive and negative. In the case of direct discrimination, the motive and intention to put a person at a disadvantage are not significant, the outcome of this unfavorable treatment is significant for the person. Today it is rare for an active subject to directly discriminate against a passive one on any grounds of discrimination. Therefore, the big problem is indirect discrimination in which active subjects put the passive ones in a less favorable position by seemingly neutral legal norms. Negative is the discrimination in which a person is placed at a disadvantage. Positive discrimination is the case when a person or group of persons is placed in a more favorable position in relation to another person or group of persons. Croatian legislation discriminates against harassment and sexual harassment. A distinction should be made between gender-based harassment and sexual harassment, sexual harassment is a form of discrimination, and gender-based harassment is not. It is not based on gender but on sexual attraction itself, and harassment occurs due to the refusal of sexual contact due to lack of mutual sexual interest. The development of labor law over the years has enabled the development of rights for workers, but unfortunately not to the same extent for men and women. Today, the position of women in the labor market has greatly improved in part due to various forms of employment such as work at home, part-time work, part-time work and the like, and self-employment opportunities. Significant progress has also been made in the area of regulations prohibiting sex discrimination at EU level. Today we have a large number of directives that regulate this, and accordingly national laws and other acts.
