Abstract
U ovom radu analizira se razvoj, nadležnosti i utjecaj Ustavnog suda Republike Hrvatske. Ustavni sud Republike Hrvatske, kao neovisna i samostalna institucija, je bitan zbog toga što ocjenjuje ustavnost zakona i ustavnost i zakonitost podzakonskih akata i drugih propisa, odlučuje o ustavnim tužbama, rješava sukobe nadležnosti među institucijama i još zbog mnogo drugih važnih zadaća. Analiziramo proces izbora sudaca za mjesto ustavnih sudaca te koliko je taj proces učinkovit prilikom odabira najboljih mogućih kandidata. Na kraju analiziramo i utjecaj koji politika ima na Ustavni sud, ovisnost Ustavnog suda o vladajućoj većini te načinu osiguravanja njegove nepristranosti.
Abstract (english)
This paper analyzes the development, competencies and influence of the Constitutional Court of the Republic of Croatia. The Constitutional Court of the Republic of Croatia, as an independent and autonomous institution, is important because it assesses the constitutionality of laws and the constitutionality and legality of bylaws and other regulations, decides on constitutional complaints, resolves conflicts of jurisdiction between institutions and many other important tasks. We analyze the process of selecting judges for the position of constitutional judges and how effective this process is in selecting the best possible candidates. Finally, we analyze the influence that politics has on the Constitutional Court, the dependence of the Constitutional Court on the ruling majority and the way of ensuring its impartiality.
