Abstract
Ovaj rad bavi se posebnim dokaznim radnjama u kaznenom postupku. Analizom relevantnih odredbi zakona i podzakonskih akata iznijele su se sve vrste posebnih dokaznih radnji. Utvrdile su se materijalne i formalne pretpostavke njihove primjene te su uspoređene s izvidnim radnjama. Poseban osvrt je dan na dokaznu radnju primjene prikrivenih istražitelja i pouzdanika te praksu Europskog suda za ljudska prava u predmetima protiv Republike Hrvatske. U radu je istaknut ograničavajući karakter posebnih dokaznih radnji te njihov utjecaj na prava i slobode osumnjičenika. Naposljetku, obrađena je tema važnosti posebnih dokaznih radnji za ishod kaznenog postupka te upotreba pribavljenih dokaza.
Abstract (english)
This paper analyzes special evidentiary actions. Using relevant laws and regulations, each form of special evidentiary action was presented. Material and formal conditions of use were assessed and compared with police inquirie actions. Special attention was paid to the use of special evidentiary action of undercover agents and confidants and practice of European court of human rights in cases against Republic of Croatia. Paper emphasizes restrictive character of special evidentiary actions and their impact on suspect's rights and freedoms. In the end, paper covered subject of importance of special evidentiary actions on the outcome of criminal proceeding and use of obtained evidence.
