Abstract | Tema mirovine, iako iz perspektive mladog čovjeka izgleda daleko, jedna je od bitnijih životnih pitanja, o kojoj bi se trebalo razmišljati puno prije navršenja 65. godine života. Koje sve vrste mirovina postoji, kada ostvarujemo pravo na mirovinu i koji je postupak za ostvarivanje tog prava pokušat ću objasniti i približiti ovim radom. Najveći fokus rada biti će na invalidskoj mirovini koja se stječe nakon postupka vještačenja radne sposobnosti, prilikom kojeg se može donijeti jedna od slijedećih ocjena: neposredna opasnost od nastanka smanjenja radne sposobnosti, smanjenje radne sposobnosti uz preostalu radnu sposobnost, djelomični gubitak radne sposobnosti ili potpuni gubitak radne sposobnosti. Osvrnut ću se i na stariju terminologiju: profesionalnu nesposobnost za rad i opću nesposobnost za rad te objasniti na koji način se ranije utvrđena invalidska mirovina po starijoj terminologiji tretira nakon donošenja novog zakona i novog nazivlja. Na koncu, objasniti ću i sam postupak ostvarivanja prava na invalidsku mirovinu, od podnošenja zahtjeva u Hrvatskom zavodu za mirovinsko osiguranje, preko postupka vještačenja u Zavodu za vještačenje, profesionalnu rehabilitaciju i zapošljavanje osoba s invaliditetom i eventualno Centru za profesionalnu rehabilitaciju, pa do mogućeg postupka pred Upravnim sudom Republike Hrvatske. Dakle, cilj ovog rada je na jednom mjestu objasniti koje sve vrste mirovina postoje, koji je način ostvarivanja prava na pojedinu od njih, s posebnim osvrtom na ostvarivanje prava na invalidsku mirovinu, tijek postupka utvrđivanja radne sposobnosti i predviđeni vremenski period u kojem pojedinac može ostvariti svoje pravo na invalidsku mirovinu. |
Abstract (english) | The topic of retirement, although it looks far from a young man's perspective, is one of the most important life issues, which should be considered long before the age of 65. What all types of pensions exist, when we exercise the right to a pension and what is the procedure for exercising that right, I will try to explain and approximate with this paper. The greatest focus of work will be on the disability pension acquired after the procedure of expertise of working capacity, during which one of the following assessments can be made: immediate danger of reduction of working capacity, reduction of working capacity with remaining working capacity, partial loss of working capacity or complete loss working ability. I will also look at older terminology: professional incapacity for work and general incapacity for work, and explain how a previously determined disability pension is treated according to older terminology after the enactment of a new law and new terminology. Finally, I will explain the procedure for exercising the right to a disability pension, from submitting a request to the Croatian Pension Insurance Institute, through the procedure of expertise in the Institute for Expertise, Vocational Rehabilitation and Employment of Persons with Disabilities and possibly the Center for Vocational Rehabilitation, before the Administrative Court of the Republic of Croatia. Therefore, the aim of this paper is to explain in one place what types of pensions exist, what is the way of exercising the right to each of them, with special reference to exercising the right to disability pension, the course of determining the ability to work and the estimated period in which an individual can exercise your right to a disability pension. |
