The aim of this thesis is to offer a comprehensive outline of the procedure for initiating and implementing a property enforcement action, as well as to analyse the amendments to the Enforcement Act which have been introduced in the past few years. The introduction offers a short explanation of what each of the novelties in the Enforcement Act brings and how they are applied in the court practice. The Second Chapter describes special conditions for making a decree of property foreclosure. The Third Chapter comprises the four main stages of enforcement, which are: enforcement filing, appraisal of the value of the property, sale of the property and clearing of debt to the lender. Chapters Four and Five expound on the legal position of the debtor and third persons after the sale of the property and on the right to housing with regard to the practice of the European Court of Human Rights and the Constitutional Court of the Republic of Croatia. Seen that one of the greatest novelties in the amended Enforcement Act is the sale of a property via the Financial Agency, Chapters Six, Seven and Eight describe the process of selling the property via the Agency, introducing us to the Logbook of properties which are sold in the enforcement process and the bylaw which is applied when a property is being foreclosed on by the Financial Agency. Chapter Nine describes the procedure in the case when the foreclosed property is not entered in the land registry while the final, Tenth Chapter, provides the conclusion based on all of the above.
