This master thesis (hereinafter: the “Thesis”) deals with the institute of the condominium ownership (ownership at the particular/individual part within a single property, hereinafter the “Condominium”). Within the first part of Thesis, the historical development of the legal institute of ownership is elaborated, and therein – the historical development of the condominium. The legal solutions valid before the enactment of the Law on Property and Other Real Rights from 1996 and the Land Registry Act from 1996 (hereinafter together referred to as the “Laws”) are presented, followed by the presentation of the solutions valid after their enactment. After the enactment of the Laws, there were many novelties in the provisions governing the institute of the Condominium and, therefore, establishment of a new real property system of the Republic of Croatia. The concept of Condominium and the concept of its registration within the land register have been completely changed. This form of ownership is essential to legally resolve the relationship between the owners of individual parts within the same property, the relationship of the property owner to the property as a whole, taking into concern his duties of managing and maintaining the entire co-owner property, as well as legal relations with third parties. Scientific methods used in Thesis: method of classification, method of analysis and synthesis, method inductions and deductions, methods of proof and refutation, and historical method.
